Frenchie Health Hub - Terms of Service

1. Acceptance of Terms

By creating an account or using Frenchie Health Hub ("Service"), you agree to be bound by these Terms of Service. The Service is operated by Soul Spark Harmony, a company registered in the Netherlands ("we", "our", "us"). Frenchie Health Hub is a trading name of Soul Spark Harmony.

If you do not agree to these terms, please do not use the Service.

2. Not Medical or Veterinary Advice

THE SERVICE IS FOR INFORMATIONAL AND TRACKING PURPOSES ONLY. IT DOES NOT CONSTITUTE PROFESSIONAL VETERINARY ADVICE, DIAGNOSIS, OR TREATMENT.

The Spark AI assistant provides general information about French Bulldog health based on the data you provide. Responses from Spark are not a substitute for consultation with a qualified veterinarian. Always seek the advice of your veterinarian for any questions regarding your dog's health, and never delay seeking professional advice based on information provided by the Service.

Soul Spark Harmony accepts no liability for decisions made based on information provided by the Service or the Spark AI assistant.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you confirm that you are 18 or older and have the legal capacity to enter into a binding agreement.

4. User Accounts

To use the Service, you must create an account with a valid email address. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account password
• All activity that occurs under your account
• Notifying us immediately of any unauthorised access at woef@frenchiehealthhub.com

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription, Trial & Payment

5.1 Free Trial

New users receive a 14-day free trial upon account creation. No credit card is required to start your trial. You will have full access to the Service during the trial period. Your trial begins on the date you create your account and ends automatically after 14 days.

5.2 Paid Subscription

After your trial ends, continued use of the Service requires a paid subscription at EUR 4.99 per month (or the applicable price displayed at the time of purchase). Subscriptions are billed monthly in advance on a recurring basis.

5.3 Payment Processing

Payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge your chosen payment method on a recurring monthly basis. Supported payment methods include credit and debit cards, iDEAL (Netherlands), SEPA Direct Debit, Bancontact (Belgium), Giropay (Germany), Przelewy24 (Poland), and Cartes Bancaires (France).

5.4 EU Withdrawal Rights

Under EU consumer law, you have a 14-day right of withdrawal for digital services. By using the Service during your free trial period, you explicitly acknowledge that your right of withdrawal is satisfied by the 14-day free trial, during which you have full access to the Service at no cost.

5.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until that date. No partial refunds are provided for unused portions of a billing period.

5.6 Refund Policy

Subscription fees are generally non-refundable. Exceptions apply in the following circumstances:

• Billing errors — if you were charged incorrectly (wrong amount, charged after cancellation, duplicate charge), we will issue a full refund of the erroneous charge
• Extended downtime — if the Service is unavailable for more than 72 consecutive hours within a billing period, you are entitled to a pro-rata service credit for the affected period

To request a refund, contact us at woef@frenchiehealthhub.com within 30 days of the charge in question.

5.7 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will not affect your current billing period and will be communicated by email.

6. User Content

You retain ownership of all data you enter into the Service, including your dog's health information, notes, and uploaded files ("User Content"). By using the Service, you grant Soul Spark Harmony a limited, non-exclusive licence to store, process, and display your User Content solely for the purpose of providing the Service to you.

We do not use your User Content for any other purpose, including training AI models or sharing with third parties, without your explicit consent.

7. Prohibited Conduct

You agree not to:

• Provide false or misleading information in your account or dog profile
• Attempt to gain unauthorised access to any part of the Service or other users' accounts
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Use the Service for any unlawful purpose or in violation of applicable regulations
• Transmit malware, spam, or any harmful code through the Service
• Harass, abuse, or harm other users or our team

8. Intellectual Property

All code, design, graphics, content, trademarks, and technology comprising the Service are the exclusive property of Soul Spark Harmony. "Frenchie Health Hub" is a trading name of Soul Spark Harmony. The Spark AI assistant and all associated branding are proprietary to Soul Spark Harmony.

You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written permission.

9. Availability & Service Changes

We aim to provide the Service 24/7 but do not guarantee uninterrupted availability. We may perform scheduled maintenance, which we will communicate in advance where possible. We reserve the right to modify, suspend, or discontinue features of the Service with reasonable notice.

10. Limitation of Liability

To the maximum extent permitted by Dutch and EU law, Soul Spark Harmony shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of data, revenue, or profits
• Any harm to your dog arising from use of or reliance on the Service or Spark AI assistant
• Service interruptions or technical failures beyond our reasonable control

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim.

11. Termination

You may delete your account at any time through account settings. We may suspend or terminate your account immediately if you materially breach these Terms, without refund of any prepaid fees (except as required by law).

Upon termination, your right to use the Service ends. Your data will be deleted in accordance with our Privacy Policy (which includes a 90-day retention period for account recovery).

12. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved amicably by contacting us at woef@frenchiehealthhub.com. If a resolution cannot be reached, disputes shall be submitted to the competent courts of the Netherlands.

As an EU consumer, you also have the right to submit a complaint to the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or prominent in-app notice at least 14 days before changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
